Welcome to PescaBite. By using the PescaBite mobile app or website, you agree to these Terms of Service. If you do not agree, do not use PescaBite.
1. Description of Service
PescaBite is a fishing intelligence app that provides bite scores, waterbody information, fishing regulations, stocking alerts, weather data, and a private catch log for New York State waters. The service uses data from public sources including USGS, NOAA, and NY Open Data.
2. Regulation Disclaimer
PescaBite is NOT legal advice. Fishing regulations displayed in the app are curated from official NYSDEC sources but may contain errors or be outdated. Always verify regulations with the official NYSDEC website or the current year's Fishing Regulations Guide before fishing. You are solely responsible for complying with all applicable laws and regulations.
3. Bite Score Disclaimer
Bite scores are algorithmic estimates based on environmental data (water temperature, flow rate, barometric pressure, solunar phase, stocking events, and tide predictions). They are intended as general guidance and do not guarantee fishing success. Environmental conditions can change rapidly and may not be fully captured by our data sources.
4. Accounts
You may use PescaBite without an account (anonymous mode) with limited functionality. Creating an account enables catch log sync, push notifications, and premium features. You are responsible for maintaining the security of your account credentials.
5. Privacy and Data
Your use of PescaBite is also governed by our Privacy Policy. Key points:
- Your catch log is private and never shared with other users
- Your location data is used only for in-app features and is never stored or sold
- We do not sell your personal information to third parties
6. Acceptable Use
You agree not to:
- Scrape, crawl, or extract data from PescaBite for commercial purposes
- Use PescaBite to violate any fishing regulations or wildlife laws
- Attempt to access other users' data or interfere with the service
- Reverse-engineer the bite score algorithm or data pipeline
- Upload harmful, illegal, or offensive content through the catch log
7. Subscriptions and Payments
PescaBite offers a free tier and an optional "PescaBite Pro" subscription with additional features. Subscriptions are billed monthly through the Apple App Store or Google Play Store and are subject to their respective terms. You may cancel your subscription at any time through your device's subscription settings.
8. Intellectual Property
The PescaBite app, brand, UI design, and bite score algorithm are the property of PescaBite. Public data from USGS, NOAA, and NY Open Data remains in the public domain. Fish illustrations used in the app are sourced from public domain collections (NOAA, USFWS, Wikimedia Commons).
9. Limitation of Liability
PescaBite is provided "as is" without warranties of any kind. We are not responsible for:
- Inaccurate or outdated regulation information
- Incorrect bite score predictions
- Interruptions in service or data availability
- Decisions you make based on information in the app
- Any injuries, fines, or losses resulting from your use of PescaBite
10. Modifications
We may update these terms from time to time. Continued use of PescaBite after changes constitutes acceptance of the updated terms. Material changes will be communicated through the app.
11. Termination
We reserve the right to suspend or terminate accounts that violate these terms. You may delete your account at any time by contacting us.
12. Governing Law
These terms are governed by the laws of the State of New York, without regard to conflict of law provisions.
